Special personal data (article 9)

We (through Officers) MUST only process this kind of information where circumstances exist such as:  

  1. the individual has given explicit consent for one or more specified purposes;  

  1. it is necessary for employment/social security/social protection law purposes;  

  1. it is necessary in relation to legal claims, or, 

  1. it is necessary for reasons of substantial public interest.  

Other grounds are potentially available.  

**Again, if an Officer is unsure as to how to lawfully process special personal data then the advice of the Data Protection Officer should be sought**
