Welcome to Lichfield District Council’s privacy notice in respect of our joint waste service processed by Lichfield District Council.
This privacy notice supplements the information the council currently makes available about how the organisation meets core data protection obligations. Our commitments are set out in our main privacy notice.
We respect your privacy and are committed to protecting your personal data. This privacy notice explains what types of personal information we collect about you, what we do with that personal information and the legal basis for our processing of your personal information. It also explains how we keep your personal information safe and secure. We take our data protection obligations very seriously and this notice gives you information about our approach to data protection legislation (UK General Data Protection Regulation, Data Protection Act 2018 and any subsequent updated legislation).
Lichfield District Council is also the data controller for your information.
The type of personal information we collect
We currently collect and process the following personal information:
- Name
- Address
- Contact information
- Company name
As part of our service, we may provide you with assisted collections. In this case we may require special data from you in the form of your medical information.
We also may inadvertently collect your personal data through the use of CCTV on some of our fleet vehicles. Please see our CCTV privacy notice for more information.
How we get the personal information and why we have it
Most of the personal information we process is provided to us directly by you for one of the following reasons:
- To provide you with the necessary and appropriate services
- To help us develop and improve our services
- To complete statistical returns to government and internal departments
We use the information that you have given us to fulfil our obligations set out in the Environmental Protection Act 1990 (other than the provision of our garden waste service).
We use the information that you have given us to fulfil the service request made by yourself to collect your garden waste.
We may share this information with Tamworth Borough Council, as this is part of a shared service.
Under the UK General Data Protection Regulation (UK GDPR), the lawful basis we rely on for processing this information (in connection with recycling and refuse collection) is our legal obligation GDPR Article 6 1(c).
Under the UK and General Data Protection Regulation (UK GDPR), the lawful basis we rely on for processing this information in connection to garden waste collection is your consent GDPR Article 61(a).
If we collect special category data to provide assisted collection under the UK and General Data Protection Regulation, the lawful bases we rely on for processing this information in connection to waste collection are
- Consent Article 6(1)(a)
- Consent Article 9(2)(a)
How we store your personal information
- Your data is stored securely on our systems and accessed only by authorised officers using their own username and password created in line with pre-defined user credentials. Personal data is also held in electronic files and the Council’s network drives. These are only accessible through personal log-on credentials and access privileges to specific drives. Access to our Council sites requires a personal electronic pass to access staff-only areas. The Council has strict procedures for the way this is done. All information about you is treated as confidential and with respect. There are also clear rules and guidance about storing, recording and sharing your information. Staff are fully trained in data management.
- All records relating to the provision of regular commercial trade waste collection from local businesses are kept for a period of six years from the date the record was created.
- All records relating to the provision of bins for trade waste are kept for a period of six years from the date the record was created.
- All records relating to the special collection of commercial waste are kept for a period of six years from the date of creation.
- All records relating to the regular collection of household rubbish from residential premises within the authority boundaries are kept for a period of three years from the date the record was created.
- All records relating to the provision of household waste containers are kept for a period of three years from the date the record was created.
- All records relating to bulky household waste collections are kept for a period of six years from the date the record was created.
- All records relating to the provision of recycling bags is kept for three years from the date the record was created.
- All records relating to residential recycling collections are kept for a period of three years from the date the record was created.
- All records relating to the development, implementation and monitoring of waste reduction programmes are kept for a period of six years from the date the record was created.
- All records relating to the provision of your garden waste service are kept for a period of three years from the date of your last subscription.
Your data protection rights
The lawful basis for processing can affect which rights are available to individuals as outlined in the table within the overarching privacy statement. Under data protection law, you have the following rights in relation to data stored by the Joint Waste Service (other than garden waste service):
- Your right of access
- Your right to rectification
- Your right to restriction of processing
Under data protection law, you have the following rights in relation to data stored by the Joint Waste Service in relation to your garden waste subscription:
- Your right of access
- Your right to rectification
- Your right to erasure
- Your right to restriction of processing
- Your right to data portability
You don’t have a right to object to processing of your personal information in relation to your garden waste subscription because you have consented to this service, although you do have a right to withdraw your consent. If you withdraw your consent for processing in relation to your garden waste subscription, however, your subscription will be terminated irrespective of the time of year and we will not be able to provide a refund.
