There has to be an unreasonable element to the activity causing the problem.
If the dust is a serious and persistent problem that significantly interferes with the enjoyment of neighbouring properties this does have the potential to constitute a statutory nuisance.
Building work by it’s nature often generates dust. If the dust meets the threshold for a statutory nuisance we may contact the company and require them to put in place mitigation measures such as enclosures or use of water to suppress the dust.
